On July 15, 1025 25-year-old University of Cincinnati Police Officer Ray Tensing pulled over 43-year-old Samuel Dubose for not having a front license plate. Officer Tensing attempted to open the car door, but Dubose pulled it shut and started the ignition of his car. While Dubose was turning the ignition Tensing put his arm inside the car in an attempt to stop Dubose from turning the ignition.

What happened then is what is at the heart of the trial. Tensing claims his arm became stuck in the car, and he was then dragged as Dubose accelerated the car, that's when Tensing says "fearing for his life", he fired a fatal shot into Dubose's head. The prosecution, however, claims that Tensing's body camera doesn't show that, but shows Tensing firing the fatal shot before the car sped away and that he wasn't dragged, but only fell on the pavement. The first trial in October of 2016 was declared a mistrial after the jury cannot agree on a verdict. The retrial is set to being May 25, 2017.
